1. Introduction
Fudie Inc. ("Fudie," "we," "us," or "our") operates the Fudie platform at fudie.ai. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI-powered food photography platform, including our website, application, and related services (collectively, the "Service"). We are committed to protecting your privacy and handling your data transparently. By using the Service, you consent to the data practices described in this policy.
2. Information We Collect
We collect information you provide directly when creating and using your account. Account Information includes your name and email address, provided during sign-up via Google OAuth or Magic Link authentication. We do not collect or store passwords — authentication is handled through Google or one-time magic links. Payment Information is processed securely through Stripe; we store only your Stripe Customer ID and subscription status, never your credit card number or banking details. User Content includes food photos and images you upload for AI processing, AI-generated images and videos created through your account, brand calibration reference photos (5-10 images), and style preferences and prompt configurations. Usage Data includes features you interact with and generation history, job modes, output formats, and variations selected, credit consumption and transaction records, and device type and browser information from HTTP headers. Team Information includes team name, member email addresses, invitation records, and brand kit configurations shared across your team.
3. How We Use Your Information
We use the information we collect for the following purposes: To Provide the Service — processing your uploaded images through AI models, generating food photography and video content, managing your account, subscription, and credit balance, facilitating team collaboration and brand kit sharing, and sending magic link authentication emails and team invitation emails. To Improve the Service — analyzing aggregated, anonymized usage patterns to improve platform features and performance, identifying and fixing technical issues, and understanding which features are most valuable to users. To Communicate With You — sending transactional emails (authentication links, team invitations), and notifying you of material changes to our terms or policies. Important: We never use your individual uploaded content or generated images to train our AI models. Your content is processed solely for the purpose of generating your requested outputs.
4. AI Processing and Third-Party Providers
To generate food photography and video content, your data is processed by the following third-party AI providers: fal.ai — processes your uploaded images and generates AI food photography and video content; your images are transmitted securely and processed according to their data processing agreements. OpenAI — analyzes brand calibration reference photos to extract style profiles (lighting, colors, composition, mood); images are sent as temporary presigned URLs that expire after use. These providers process your content solely to deliver the requested outputs. We have data processing agreements with each provider that prohibit them from using your content for model training or any purpose other than fulfilling our service requests.
5. Content Storage and Security
Your content is stored on Cloudflare R2 (S3-compatible encrypted cloud storage). All images and videos are accessed through time-limited presigned URLs that expire after 1 hour, meaning no permanent public URLs exist for your content. Data in transit is encrypted using TLS/HTTPS. We implement CSRF protection on all authenticated endpoints, rate limiting to prevent brute-force attacks, JWT-based authentication with 7-day expiration, and Redis-backed session management with automatic token invalidation. Uploaded images are automatically deleted after 7 days. Generated outputs are automatically deleted after 30 days. Brand calibration reference images are retained as long as your account is active.
6. Data Sharing
We do not sell, rent, or trade your personal information. We share data only with service providers necessary to operate the platform: Stripe for secure payment processing (receives your email and subscription data), Cloudflare R2 for encrypted content storage, fal.ai for AI image and video generation, OpenAI for brand calibration analysis, and ZeptoMail (by Zoho) for transactional email delivery (authentication links and team invitations). All providers are bound by data processing agreements. We may also disclose information if required by law, legal process, or government request, or to protect the rights, property, or safety of Fudie, our users, or the public.
7. Cookies and Tracking
We use minimal cookies required for the platform to function. On the landing page (fudie.ai), we use only a NEXT_LOCALE cookie to remember your language preference (English or Spanish), which expires after 1 year. On the authenticated application, we use NextAuth session cookies for authentication (HTTP-only, secure) and CSRF protection tokens. We do not use third-party advertising cookies, analytics tracking pixels, social media tracking widgets, device fingerprinting, or cross-site tracking of any kind. 8. Data Retention
We retain your data according to the following schedule: Account data (name, email) is retained for as long as your account is active. Uploaded input images are automatically deleted from storage after 7 days. Generated output images and videos are automatically deleted from storage after 30 days. Brand calibration reference images are retained while your account is active. Magic link tokens expire and are invalidated after 1 hour. Team invitation tokens expire after 7 days. Credit transaction history is retained for the life of your account. Job history records (without image files) are retained for the life of your account. Upon account deletion, we remove your personal data, uploaded content, and generated outputs within 30 days. Anonymized, aggregated usage statistics may be retained indefinitely.
9. Your Rights
You have the right to: Access your personal data — view your account information, generation history, and credit transactions through your account settings. Correct your data — update your account information at any time. Delete your data — request complete account deletion by contacting [email protected]; we process deletion requests within 30 days. Export your data — download your generated content before the 30-day retention period expires. Restrict processing — opt out of non-essential data processing. Object to processing — contact us if you object to how we process your data. Depending on your jurisdiction, you may have additional rights under applicable data protection laws (such as GDPR, CCPA, or similar regulations). 10. International Data Transfers
Your data may be processed in the United States and other countries where our service providers operate. We ensure appropriate safeguards are in place for international data transfers, including standard contractual clauses where applicable. By using the Service, you consent to the transfer of your data to these jurisdictions.
11. Children's Privacy
Fudie is not intended for use by individuals under 16 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child under 16, we will take steps to delete that information.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes via email or through a notice on our platform at least 30 days before changes take effect. The date at the top of this page indicates when the policy was last revised. Continued use of the Service after changes take effect constitutes acceptance of the updated policy.
