Terms of Service

Last updated: February 1, 2026

1. Acceptance of Terms

By accessing or using the Fudie platform at fudie.ai (the "Service"), operated by Fudie Inc. ("Fudie," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including paid subscribers, team owners and team members, and visitors to our website.

2. Description of Service

Fudie is an AI-powered food photography and visual content generation platform for restaurants, delivery apps, and food brands. The Service includes: AI image generation, enhancement, and restyling from uploaded food photos or text descriptions; AI video generation from still food images with motion presets; image upscaling up to 4x resolution; brand calibration using AI analysis of your existing photography; team collaboration with shared brand kits, style presets, and credit pools; batch generation for menu launches across multiple dishes; and API access for programmatic content generation (on eligible plans). We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration and Security

To use the Service, you must create an account using Google OAuth or Magic Link (passwordless email) authentication. You must provide accurate and complete information. You are responsible for all activities that occur under your account and must notify us immediately of any unauthorized use at [email protected]. We do not store passwords. Authentication is handled through Google OAuth tokens or one-time magic links that expire after 1 hour. Sessions expire after 7 days, after which you must re-authenticate.

4. Subscription Plans and Billing

Fudie offers three subscription tiers: Appetizer ($29/month or $290/year), Main Course ($79/month or $790/year), and The Banquet ($199/month or $1,990/year). Each plan includes a monthly credit allocation and specific feature limits as described on our pricing page. By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle through our payment processor, Stripe. Subscription credits are granted at the start of each billing cycle and roll over for up to 3 billing cycles. One-time purchased credit packs never expire. All prices are in US dollars. We may change our pricing with at least 30 days advance notice via email.

5. Credits and Usage

The Service uses a credit-based system where 1 credit equals 1 AI-generated photo. Video generation costs 4-7 credits depending on duration. Image upscaling costs 1 credit. Credits are reserved (held) when a job is submitted and consumed upon successful completion. If a job fails, credits are automatically released back to your account. Total cost depends on the number of output formats, variations, and video duration selected. The real-time cost is displayed before generation. Concurrent job limits are enforced per plan (1 for Appetizer, 3 for Main Course, 8 for The Banquet).

6. Teams and Collaboration

Team features allow multiple users to share brand kits, style presets, and credit pools. The team owner manages invitations, membership, and brand kit settings. Team seats are limited by your subscription plan (1, 3, or 10 seats). Pending invitations count toward seat limits. When a user joins a team, their personal credits transfer to the team pool. The team owner is responsible for all usage by team members. Users with active personal subscriptions must cancel before joining another team.

7. Content Ownership and License

You retain full ownership of all images and content you upload to Fudie. You also own all AI-generated outputs (images and videos) created through your account. By uploading content, you grant Fudie a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service. This license terminates when your content is deleted. We will never use your individual uploaded content or generated outputs to train AI models. We will never sell or share your content with third parties for their own use. Your content may be processed by our AI infrastructure providers (fal.ai, OpenAI) solely to generate your requested outputs, under data processing agreements that prohibit any other use.

8. Acceptable Use

You agree not to: generate content that is illegal, harmful, obscene, or infringes on the rights of others; upload content you do not have the right to use; attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms; circumvent usage limits, rate limiting, or credit system mechanisms; use automated means to access the Service beyond the provided API; resell, sublicense, or redistribute access to the Service without authorization; impersonate another person or misrepresent your affiliation; or interfere with or disrupt the Service or servers. Violation of these terms may result in immediate account suspension or termination at our discretion.

9. AI-Generated Content Disclaimer

AI-generated food photography is intended to represent and enhance the visual appeal of your dishes. Generated content may not be a perfectly accurate representation of actual food items. You are responsible for ensuring that AI-generated content used in marketing, menus, or advertising is not misleading to consumers. Fudie provides quality scores and review flags to help identify outputs that may need attention, but final review and approval is your responsibility.

10. Data Retention and Deletion

Uploaded input images are automatically deleted from our storage after 7 days. Generated output images and videos are automatically deleted after 30 days. You should download and save any content you wish to keep before these retention periods expire. Brand calibration reference images are retained as long as your account is active. Job history records (without image files) are retained for the life of your account. Upon account termination, we delete your personal data and content within 30 days.

11. Trial Availability

Fudie does not currently offer a free trial. Billing and subscription terms apply from the date of your first paid charge.

12. Limitation of Liability

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your specific requirements. In no event shall Fudie, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for all claims arising from or relating to the Service shall not exceed the total amount you paid to Fudie in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fudie and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your content, or your infringement of any third-party rights.

14. Termination

You may cancel your subscription at any time through your account settings. Your access continues until the end of your current billing period. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately, though we will retain your data according to our data retention schedule.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before changes take effect. The date at the top of this page indicates when the Terms were last revised. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you should discontinue use of the Service before the effective date.
